Financed a car that was previously totaled and dealership did not inform me when I asked, can anything be done?
Question by ryan: Financed a car that was previously totaled and dealership did not inform me when I asked, can anything be done?
I live in georgia just incase state law has anything to do with it. I went to dodge jeep and chrysler to get my 03 jeep, I financed with someone I’m assuming they have a split participation agreement with. Before signing for the car, I asked if it had ever been wrecked and they said no its had a clean history. Well ever since I bought it its been giving me trouble. When working on it one day i noticed some spot welding on the driver side under the hud. Then a couple days ago I got a letter in the mail and something caught my eye, the words “salvaged title” I quickly called the bank and asked about it and they said the car had been totaled and that dodge jeep and chrysler had it rebuilt. From what a friend of mine told me, its illegal to finance a car that was totaled and that the financers probably over looked it because they work with dodge jeep and chrysler. Is there anything that can be done? Thanks

You can almost surely get ALL your money refunded including registration, insurance, incidentals, travel, your time, etc etc; and the seller should get fined.
I’d research the law on this: call about 10 lawyers in the consumer law field in your state & area and ask for advice on the phone. It’s free, and they’r sizing you up as a potential client.
Ask em how to research this, among other things beyond criminal proceedings at the atty gen, like how much you should be refunded, reporting this to the feds, small claims court, state consumer protection office, etc.
Have all your documentation handy.
The more you know, the more you will be able to negotiate a rich deal w/ the seller.
I followed that approach w/ Honda and got them to buy back my new-repo Accord that they botched a paint & body job on after it was hit shortly after I bought it.
At first, they said No way, but ended up paying me the selling price – 0.

They have to disclose that it’s a salvage title. Go talk to them and if they won’t make it right call a lawyer.
